the guideline says: "Never use "(TM)" or "(R)" (or the Unicode equivalents, ™/®). It is incredibly complicated to use these properly, so it is actually safer for us to not use them at all."

You're not the only one to ever touch or subsequently distribute the package or its constituent parts. The document is a guideline for the openSUSE community at scale, and it simply is not possible at all times that every part of the chain has enough understanding of the legalese, let alone stay on top of it in case things do change. (It also looks ugly, and if the legal team says it's ok to omit it without getting into a worse situation, then by all means.)
