The spec file itself should explain how is it licensed
It allows to be licensed as either of MIT or Apache (both valid)
I guess you missed my point - spec file should state this file is licensed as XY - see default preamble of almost any SUSE spec file - it is considered not ok to distribute something that is considered source code (even if its just a spec file) - in fact in some countries it is interpreted as no stated license = cant be distributed
